O Projeto de Lei 4.288\/2021, em tramita\u00e7\u00e3o na C\u00e2mara dos Deputados, possibilita o div\u00f3rcio ap\u00f3s a morte de um dos c\u00f4njuges. O texto prev\u00ea essa hip\u00f3tese quando a a\u00e7\u00e3o for iniciada antes do falecimento e os herdeiros optarem por dar prosseguimento.<\/p>\n

A proposta, de autoria do deputado Carlos Bezerra (MDB-MT), ser\u00e1 analisada em car\u00e1ter conclusivo pela Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a e de Cidadania. Segundo o parlamentar, atualmente, a \u00fanica alternativa juridicamente poss\u00edvel nestes casos \u00e9 a dissolu\u00e7\u00e3o do casamento v\u00e1lido pela morte de um dos c\u00f4njuges.<\/p>\n

O deputado entende que isso contraria o interesse e a vontade daqueles que, antes de falecerem, haviam pedido para finalizar o casamento pelo div\u00f3rcio. “O div\u00f3rcio \u00e9 um direito incondicional de qualquer um dos c\u00f4njuges a prescindir de contradit\u00f3rio ou dila\u00e7\u00f5es indevidas, exceto no tocante a quest\u00f5es que envolvam o patrim\u00f4nio ou interesses de filhos menores e incapazes.”<\/p>\n

Para Carlos Bezerra, o projeto deve aprimorar o C\u00f3digo Civil para estabelecer expressamente a possibilidade de div\u00f3rcio ap\u00f3s a morte. A justificativa do projeto cita julgamento do Tribunal de Justi\u00e7a de Minas Gerais \u2013 TJMG, no qual prevaleceu a tese do advogado Rodrigo da Cunha Pereira, presidente do Instituto Brasileiro de Direito de Fam\u00edlia \u2013 IBDFAM.<\/p>\n

Perverter o esp\u00edrito maior da lei<\/p>\n

Em agosto de 2021, o TJMG concedeu o div\u00f3rcio post mortem ao apreciar um recurso movido pela filha de um homem que morreu, no ano anterior, por Covid-19. O presidente do IBDFAM atuou no caso em que o marido entrou com o pedido de partilha de bens, mas morreu no curso do processo.<\/p>\n

A quest\u00e3o foi inicialmente julgada sem resolu\u00e7\u00e3o de m\u00e9rito em raz\u00e3o da morte de uma das partes. Para Rodrigo da Cunha Pereira, \u201catribuir o estado civil de viuvez a quem j\u00e1 tinha se manifestado, e at\u00e9 tentando concretizar o div\u00f3rcio pela via judicial, \u00e9 perverter o esp\u00edrito maior da lei, que deve sempre ser interpretada em conson\u00e2ncia com outras fontes do Direito\u201d.<\/p>\n

O advogado avalia positivamente iniciativa da proposta legislativa, \u201cpois deixar de se decretar o div\u00f3rcio, quando uma, ou mesmo ambas as partes falecem no curso do processo, seja consensual ou litigioso, \u00e9 fazer da lei (regra jur\u00eddica) um fetiche, \u00e9 inverter a rela\u00e7\u00e3o sujeito\/objeto, e apegar-se excessivamente \u00e0 formalidade jur\u00eddica em detrimento de sua ess\u00eancia\u201d.<\/p>\n

Rodrigo entende que, \u201cse o casamento j\u00e1 havia acabado, os seus efeitos jur\u00eddicos devem se dar a partir da separa\u00e7\u00e3o de fato do casal, associado \u00e0 inten\u00e7\u00e3o de n\u00e3o mais voltarem ao casamento\u201d. \u201cPortanto, necess\u00e1ria a aprova\u00e7\u00e3o da respectiva proposta legislativa, para dar efetividade \u00e0 verdadeira inten\u00e7\u00e3o da Emenda Constitucional n. 66, que tornou o div\u00f3rcio um direito potestativo, n\u00e3o cabendo mais poder-dever e, sim, poder de sujei\u00e7\u00e3o quando uma das partes deseja.\u201d
